Reasons
Punishment of the crime
The representative meeting of occupants and its members shall not illegally acquire or provide property or property benefits in connection with the management of multi-family housing.
From June 1, 2014, the defendant is the chairperson of the tenant representative meeting of the Busan So-gu Seoul apartment from June 1, 2014.
1. On February 16, 2015, the Defendant entered into a “multi-family housing consignment contract” of the above apartment as KRW 1,500,000 per month by means of a multiple contract with D representative director E around February 16, 2015, and written a written contract in advance, stating the date of the contract as the date of February 17, 2015.
The Defendant did not notify this to the members of the occupants’ representative meeting, without having resolved the contract with the above company as a unanimous meeting, and then illegally acquired property benefits in relation to the management of collective housing by being provided with meals and alcoholic beverages equivalent to KRW 1,263,00 per person, and KRW 63,150 per person, under the pretext of auditing the conclusion of the contract from the above E, in the “G restaurant” located in F of Busan Metropolitan City.

On February 24, 2015, around February 24, 2015, the Defendant concluded a “contract for rooftop waterproofing and painting construction work” with the representative director I of H Co., Ltd. around February 24, 2015, the Defendant: (a) concluded a “contract for rooftop waterproofing and painting construction work” with I; and (b) provided that “The Defendant would pay KRW 1 million for the cost of apartment construction, cleaning and management office employees; and (c) would request KRW 1 million for gift certificates.”
On March 2015, the Defendant received 100,000 won from I and illegally acquired property in relation to the management of multi-family housing at the office of the representative meeting of occupants of the above apartment on the first and second day.
