Reasons
Punishment of the crime
[criminal records] On November 13, 2015, the Defendant was sentenced to one year of suspension of execution in six months of imprisonment with prison labor due to a violation of the Labor Standards Act at the Seoul Southern District Court, and such judgment became final and conclusive on January 21, 2016.
[2015 Highest 1954] The Defendant is a representative of C Co., Ltd. in Guro-gu Seoul Metropolitan Government, who employs 50 full-time workers and operates software development business.
Defendant did not pay KRW D’s wages on December 2, 2013, wages from March 18, 2013 to March 17, 2014; wages on February 2014; wages on March 3, 2014; retirement allowances; retirement allowances; etc. totaling KRW 10,189,065, and retirement allowances; from March 17, 2014 to August 28, 2014; paid KRW 4,59,469, total amount of wages on August 2014; and paid KRW 4,59,469, within 14 days from the date of retirement without agreement between the respective parties on the extension of the payment date.
[2] As the representative of a stock company C, the Defendant, who was employed by the said workplace from June 3, 2013 to October 17, 2014, did not pay the total of KRW 18,684,366, total amount of wages and annual average retirement pay, retirement pay, etc. from January 3, 2013 to October 17, 2014; from April 22, 2013 to October 17, 2014 to October 17, 2014; and paid KRW 15,620,064, total amount of wages and annual average retirement pay from May 2, 2013 to October 2014 to 30, 2014; and paid KRW 15,620,064, total amount of retirement pay from May 2, 2013 to October 17, 2014 to 30, 2014.
[2015 Highest 4717] The Defendant, as the representative of the Co., Ltd. C, did not pay the amount of wages 1,112,903 from January 20, 2015 to February 12, 2015 at the said workplace within 14 days from the date of retirement without agreement between the parties on the extension of payment dates.
[2015 Highest 4972] The Defendant, as the representative of C Co., Ltd., was the Defendant at the said workplace, from May 8, 2013 to July 22, 2014.
