1. The defendant shall be punished by imprisonment with prison labor for one and half years;

2.However, the above sentence shall be executed for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2015 Highest 1565] The defendant is the representative director of the corporation C, which is located in Heak-gu Seoul Metropolitan Government B, who runs the business of manufacturing electronic parts by making use of 49 full-time workers.

1. An employer in violation of the Labor Standards Act shall pay wages within 14 days after the cause for such payment occurred, in case where a worker retires;

From November 4, 2013 to February 17, 2015, the Defendant did not pay the retired worker D totaling KRW 3,165,220,65 of wages on December 2014, 2014, KRW 3,165,215, KRW 1,880,280 of wages on February 1, 2015, KRW 625,750 of the annual settlement refund at the end of 2014, and KRW 8,891,910 of the annual settlement refund at the end of 2014, as stated in the current status of the arrears in attached Form 1 and the statement on the details of the money and valuables in arrears by each individual of attached Form 2, KRW 149,860,440 of the retirement worker D, KRW 6,515,09, KRW 160 of the annual settlement refund on January 15, 2014, KRW 306,468,20.

2. An employer who violates the Guarantee of Retirement Benefits for a worker shall pay a retirement allowance within 14 days after the ground for such payment occurred, in case where the worker retires.

From November 4, 2013 to February 17, 2015, the Defendant, as well as the amount of KRW 4,594,901 of the retirement pay of retired workers D, who were employed in the said workplace, and were employed in the said workplace from November 4, 2013 to February 17, 2015, did not pay a total of KRW 168,132,180 of the retirement pay of 25 employees within 14 days from the date of retirement, as stated in the current status of arrears and the details of money and valuables in

[2016 Highest 745] Defendant is a person who operates an electronic component manufacturing business by using eight full-time workers in the company located in Heak-gu Seoul Metropolitan Government B.

1. When a worker dies or retires, the employer who is obligated to pay wages, bonuses, or refunds on the settlement of accounts at the end of each year shall do so within fourteen days after the cause for such payment occurred;
