Punishment of the crime

[criminal history] On June 14, 2016, the Defendant was sentenced to four months of imprisonment with prison labor due to night-time intrusion larceny in the Youngcheon District Court’s territorial support, and completed the execution of the sentence in Chuncheon prison on October 13, 2016.

[Criminal facts]

1. On January 6, 2018, the Defendant thief: (a) at E main points operated by the victim D in Pyeongtaek-si C on January 6, 2018; (b) at the mobile phone case in which the victim spawn spawn with the victim while drinking alcohol together with the victim, the Defendant thief takes off each of the above victim’s Saemaul safe cream card and the new bank cream card in the name of the victim; and (c) one card in the name of the victim F.

In other words, they stolen them.

2. On January 7, 2018, the Defendant attempted to commit fraud: (a) presented the following: (b) the new card in the name of F that stolen was presented to the victim as a legitimate holder, as set forth in paragraph (1) for the settlement of KRW 180,000,000 operated by the victim H in Pyeongtaek-si G; (c) but (d) failed to commit an attempted act on the wind for which the card transaction was not approved due to lack of limits.

3. On January 7, 2018, in order to pay KRW 180,00,00, the Defendant attempted to avoid the payment of the horse charges and obtain pecuniary benefits equivalent to the same amount by presenting the completion of the community credit cooperative in the name of D, which was stolen, as set forth in paragraph (1), to the victim H, as if the lawful holder was the lawful holder, at a place of the massage procedure around January 7, 2018. However, the Defendant attempted to avoid the payment of the horse charges and to obtain pecuniary benefits equivalent to the same amount by allowing the victim to pay the horse charges, but failed to do so due to the detection of the fact of using the stolen liquid card and arrest of the victim H.
