A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 특정범죄 가중처벌 등에 관한 법률위반( 위험 운전 치상) 피고인은 2017. 12. 16. 00:35 경 혈 중 알코올 농도 0.280%( 혈액 감정결과) 의 음주 영향으로 정상적인 운전이 곤란한 상태로 B 미니 쿠퍼 승용차를 운전하여 광주시 오포 읍 세 피 내 길에 있는 45번 국도 고산 IC 부근 편도 2 차로 중 1 차로를 광주시 방면에서 용인시 방면으로 진행하는 과정에서 술에 취하여 전방 주시의무를 소홀히 한 과실로 피의 차량 좌측 앞 범퍼 부분으로 좌측 중앙 분리대를 충돌하고 그 충격으로 우측으로 튕겨 나가 피의 차량 우측 뒷 범퍼 부분으로 같은 방향 2 차로로 진행 중이 던 C 순찰차의 좌측면 부분을 충격하는 교통사고를 야기하였다.
