A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
1. The Defendant, along with C, conspiredd with C to acquire 350,000 won of the opening fee per mobile phone by fraud as if the credit rating would be increased and later would be able to obtain a loan later, if he/she opens a mobile phone to many and unspecified persons via virtual phone.
From October 2012 to January 3, 2013, the Defendant, along with C, prepared an office on the third floor of the building located in Dobong-gu Seoul Metropolitan Government, from January 8, 2013 to January 11, 2013, from the second floor of the building located in Dobong-gu, and had F, G, H, I, etc. employ counseling staff, and let them open a cell phone to the victims on the basis of personal information provided by the Defendant and counseling phrases.
Accordingly, on October 2012, one of the counseling staff members stated to the effect that “the person in charge of the savings bank is the person in charge of the savings bank. The credit rating may be increased so that loans may be made available, and to do so, he/she must join the mobile phone of the telecommunications agency who has taken a leave of absence with the bank in Korea.” The mobile phone is not actually opened, but is not registered only on the basis of the computer name.”
However, the defendant did not have the intention or ability to raise the credit rating of the victim, and the above mobile phone was actually opened, and there was a duty to pay the victim according to the opening of the mobile phone.
The Defendant received 350,000 won from the victim by facsimile the relevant documents, such as identification card necessary for opening the mobile phone, and then delivered the documents to the intermediary business operator who is unable to know his name connected to the mobile phone agent, and received 350,000 won from the victim.
The Defendant, including this, in collusion with C, was 205 cell phones from October 2012 to January 21, 2013 by deceiving the victims, such as the list of crimes in the annexed list of crimes.
