Defendant

A shall be punished by imprisonment with prison labor for a year and six months, and by imprisonment with prison labor for a period of ten months.

Punishment of the crime

Even if the Defendants were not the persons handling narcotics, the Defendants treated the psychotropic drugs-related Mesofts (i.e., one philophone; hereinafter referred to as “philophones”) as follows:

1. Defendant A

A. (1) On May 23, 2016, the Defendant sold 0.7 grams to F at least 40,000,000, in the F’s residence located in E at E, E, i.e., the Defendant sold 0.7 grams to F.

(2) At around 15:30 on May 26, 2016, the Defendant: (a) requested F to sell phiphones at the H hotel parking lot located in G in Silung-si, G to sell phiphones; and (b) allowed F to sell phiphones for approximately 0.3g of 40,000 won from the stairs of the 3rd floor of the I building in Silung-si on the same day.

Accordingly, the Defendant conspiredd with F to sell phiphones as above.

(3) On May 27, 2016, around 18:00, the Defendant sold approximately 0.5g of phiphonephones to J at an insular place (hereinafter referred to as “J”) in the Gyeonggi-si (Seoul-dong).

B. (1) On April 2016, the Defendant: (a) 09:00 on the first half of 2016, administered phiphones in a way that the Defendant laid about 0.4g of phiphones with F, J, etc. on a gambling place; and (b) laid the phiphones by heating them on a gambling place; and (c) laid down the phiphones in a way that the phiphones are cut off.

Accordingly, the Defendant administered phiphones jointly with F, J, etc.

(2) On May 23, 2016, at around 23:40, the Defendant, along with B, F, and J, laid down the volume of phiphones into the stuffed place, and laid down the phiphones by heating the frophones in a string manner.

Accordingly, the Defendant administered philophones jointly with B, F, and J.

(3) On May 24, 2016, at around 23:00, the Defendant administered philophones by inserting the volume of philophones on the gambling place along with B and F at the residence of the above F, and heating the philophones by inserting the smoke.

Accordingly, the Defendant administered philophones jointly with B and F.

2. Defendant B
