A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On February 12, 2013, the Defendant issued a summary order of KRW 2.5 million as a fine for a violation of the Road Traffic Act, etc. at the Gwangju District Court on February 12, 2013, and on August 7, 2018, the same court issued a fine of KRW 3 million as a crime of violation of the Road Traffic Act.

On January 16, 2020, at around 03:25, the Defendant driven B rocketing car with blood alcohol concentration of 0.112% without a driver’s license, and proceeded to turn to the left from the right edge of the c elementary school at the 379-ro 83 subordinate office of Gwangju Mine-ro, Kai-ro 379, the lower court.

There have been a duty of care to safely proceed to a person who is engaged in driving of a motor vehicle in accordance with the new code because the traffic control was conducted by the signal apparatus.

Nevertheless, under the influence of alcohol, the Defendant was under the influence of alcohol to the left-hand turn of the stop head, and was driven by the victim D (V, 60 years old) who was under the influence of the Defendant under the influence of alcohol, with the front-hand part of the driver’s seat of the vehicle of the Defendant.
