A. The defendant educational foundation C shall have the defendant educational foundation B on February 1, 1971.

1. Basic facts

A. The Plaintiff’s relationship 1) The Plaintiff is the deceased D (hereinafter “the deceased”).

(1) The real estate stated in the separate sheet (hereinafter “instant real estate”) shall be the real estate (hereinafter “instant real estate”) as an incorporated foundation E, a foundation established around March 194, after obtaining permission for its establishment on January 25, 1964 pursuant to the enactment of the Private School Act.

Defendant School Foundation B (hereinafter “Defendant B”) on March 22, 1986 on the ground of the 11st parcel, including B, on the land.

(3) A school building, the ownership of which has been registered under its name (hereinafter “instant building”).

The current registration details are as shown in Attachment 2. Although the construction year of the building of this case is unclear, it is maintained without permission, and the registration of ownership transfer in the name of Defendant B was made on March 22, 1986, and on May 15, 200, the registration of ownership transfer in the name of the Plaintiff was made on April 4, 200. The Defendant B is establishing and operating the Fhigh School in the above building after being donated on April 4, 200. (2) The Foundation B established by the Deceased on April 26, 1952 is a school juristic person whose organization was changed.

3) Defendant School Foundation C (hereinafter “Defendant C”) is only the case.

(B) The deceased, a foundation established on March 12, 1955, G (hereinafter referred to as “G”) is an incorporated foundation.

(B) The name of the Foundation C was changed on April 8, 1963, but its organization was changed upon permission for establishment on January 25, 1964. As to the instant real estate, the registration for ownership transfer was made in the name of G as of April 8, 1955. (B) The process of the establishment of the Defendants and the records related to the instant real estate 1) the Deceased purchased the instant real estate from Japan, Japan on October 11, 1943 and completed the registration for ownership transfer, but donated the instant real estate to the Foundation B on February 1, 1951.

However, on the ground that the instant real estate was owned by Japan, registration of preservation of ownership was made in the name of the Republic of Korea on the ground that it was the property devolving upon the Republic of Korea.
