1. 공무집행방해 피고인은 2016. 10. 07. 18:30경 서울 용산구 E에 있는 ‘F파출소’ 앞길에서, ‘경찰이 싫다’는 이유로 F파출소 앞 도로에 주차된 순찰차 트렁크 부분을 주먹으로 강하게 내리치다 그 경위를 묻는 서울용산경찰서 F파출소 소속 경위 G에게, ‘야 왜 내가 치면 안 되냐, 씹할 놈들아’라고 욕설을 하고, G이 공용물건에 대해 주먹으로 치면 안된다고 주의를 주자 손바닥으로 G의 가슴을 2회 밀고 손가락으로 가슴을 수 회 찌르며, ‘야 씹할 놈아’ ‘칠십살 먹은 농민을 물대포고 쏴 죽인 놈들아!’ ‘야, 맞장떠, 씹새끼야. 좇도 아닌게.’ ‘ 씨발 느그 아버지 엄마가 그렇게 키우더냐. 씨발새끼야. 사람을 죽이고, 이씨발새끼.’라고 욕설하면서 피우던 담배꽁초를 바닥에 버리고, 이에 대해 오물투기 혐의로 통고 처분하고자, 위 G이 단속 PDA 및 휴대용프린트를 조작하자 손가락으로 G의 가슴을 수차례 찌르고, 손등을 내리쳐 조회기를 떨어뜨리게 하였다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers concerning the prevention, suppression and investigation of crimes.
