The defendants are all innocent.
Reasons
On January 25, 2011, the Defendant established B with the purpose of real estate implementation projects around January 25, 201, and operates the above company until now.
From September 25, 2012, the Defendant: (a) from around 2012 to around 1,146, on a site of approximately 1,146 parcel C, Daegu-gu, and approximately 8 parcels; (b) obtained a building permit for the construction of five stories underground; (c) 614 households of 29 stories above ground; and (d) the construction of a neighboring commercial building by means of a land trust; and (e) obtained a building permit for the construction of a new building on a site of approximately 1,146 parcel, Daegu-gu, Daegu-gu, and about 8 parcels of land from the Daegu-gu, Daegu-gu, and about 1,146 site of approximately 5 stories underground, 614 households of officetels of 29 stories above ground, and neighboring commercial building (hereinafter “new construction”).
The Defendant had no adequate own capital at the time of carrying out this new construction project, and thus, it was inevitable to lend money to other persons such as the victim to raise funds for the purchase price and construction cost of the land for the project.
After that, the Defendant received a letter of intent to participate in trust in order to implement a project as a method of implementing a land trust project for management type, but failed to secure a complete ownership of the site for new construction project, failed to give up the method of implementing a land trust project for management type for reasons of failure to select a construction project even, and decided to implement a project by a land trust method for sale and development type with less profits from an exercise of time than the method of implementing a land trust project for management type around December 2015.
On May 30, 2016, the Defendant concluded a land trust contract with D Co., Ltd. for sale and development-type land, and participated in the construction project by the trust company. Under the guarantee of the contractor, the Defendant received 7 savings banks such as F Co., Ltd. from 7 savings banks such as F Co., Ltd., and paid the full purchase price for the new construction site to each prop.
E Co., Ltd. commenced a new construction work on August 2016.
D Co., Ltd. is from the point of December 2016.
