A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

The Defendant was unable to pay interest of KRW 300,000,000 per month for KRW 200,000 per month from a bond company and interest of KRW 200,000 through KRW 300,00 per month for KRW 10,000 from a loan company. The Defendant had no intent or ability to pay such interest even if it borrowed money from a credit company due to the fact that it was in excess of KRW 50,00,000 from a credit company.

1. Around June 28, 2010, the Defendant made a false statement to the effect that “A victim E (the 50-year-old-old-old-old-dong-dong-dong-dong-gu-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-si

However, the Defendant did not have any reason to raise KRW 100 million, and there was no intention or ability to repay the above money to the victim due to bond, loan, and card arrears as above.

The Defendant, as such, by deceiving the victim, received KRW 10 million from the victim as the borrowed money in the same place.

2. Around July 2, 2010, the Defendant received KRW 20 million from the victim from the victim and made a false statement in the same manner as the preceding paragraph.

However, the Defendant did not have any reason to raise KRW 100 million, and there was no intention or ability to repay the above money to the victim due to bond, loan, and card arrears as above.

The Defendant, as such, by deceiving the victim, received KRW 20 million from the victim as the borrowed money in the same place.

3. Around August 23, 2010, the Defendant made a false statement to the victim that “I will complete payment within six months with the interest of two copies per month, if I wish to lend the amount of KRW 20 million to the victim as I wish to do so.”
