A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. On September 7, 2011, the Defendant found the victim along with E at the office of the victim D located in Chungcheongnam-si, Chungcheongnam-si, and made a false statement that “I will use only 10 million won, which is needed to pay the amount, to be paid back to the victim. I believe that E would have borrowed a guarantee, and that E would be able to know the interest later.”
However, in fact, the Defendant had no intention or ability to repay money within the agreed time limit, even if he/she borrowed money from the victim due to bad credit standing since 2007, as a person who lives with money borrowed from another person without a certain occupation.
As above, the Defendant, by deceiving the victim as above, received KRW 10 million from the victim as the loan money on the same day.
2. Around September 21, 2011, the Defendant found the victim D’s office located in Chungcheongnam-si, Chungcheongnam-si, and concluded a false statement that “A livestock raiser, who had had a livestock farmer in dub, would use his own land to be inside, would be offered as security to the agricultural cooperative and would be loaned KRW 50 million to the agricultural cooperative. As such, if a loan is extended to KRW 20 million,00,000,000,000,000 prior to the loan, including KRW 10,000,000,000,000, not later than October 11, 2011.”

3. Around October 18, 2011, the Defendant was found to be the victim D’s office located in Chungcheongnam-si, Chungcheongnam-si, and an attachment is made against the victim’s land that was created by the livestock raiser in mountain, with the amount of KRW 10 million.
