Defendant B and J Co., Ltd concluded on August 17, 2015 with respect to the real estate set forth in attached Table 1 List 1.
Reasons
1. Basic facts
A. On June 27, 2013, the Plaintiff entered into a contract between the Plaintiff and J and completed the construction (i) the Plaintiff is Gangwon-do Crossing-gun and eight parcels (hereinafter collectively referred to as “instant land”).
(2) The construction project for housing site formation (hereinafter referred to as the “instant construction project”).
(2) The Plaintiff and the J concluded a contract with the content that the construction cost was 1,600,000,000 (including value-added tax) and the construction period was 1/1,000 per day from July 1, 2013 to December 31, 2013, respectively; and (2) the Plaintiff and the J concluded a contract with the content that the completion date was changed to September 30, 2014 on June 13, 2014, and that the completion date was changed to October 31, 2014.
3) The Plaintiff completed the instant construction. On March 27, 2015, J received a pre-use inspection certificate from the Crossing-gun on the Gangwon-do and ten parcels, the land for the instant construction. 4) The J paid to the Plaintiff KRW 115,00,000 as the construction cost of the instant construction, July 6, 2015, and KRW 40,000,000, and KRW 100,000,000 on July 7, 2015, respectively. On July 17, 2015, J paid the Plaintiff the construction payment obligation of KRW 115,000,000 to N Co., Ltd. on behalf of the Plaintiff.
B. The J and the Defendants: (a) divided the instant land into several parcels; and (b) transferred the ownership of each of the real estate listed in the separate sheet No. 1, respectively, to the Defendants as indicated in the following table.
