Reasons
Punishment of the crime
1. Violation of the Immigration Control Act;
A. An illegal alien may stay in the Republic of Korea within the scope of his/her sojourn status and sojourn period, and the accused is a national of the Thailand.
Nevertheless, the Defendant entered the country of visa exemption (B1) through the Incheon International Airport on December 13, 2017, and continued to illegally stay in the Gyeonglbuk-gun from the expiration date of the period of sojourn until July 12, 2019, despite the expiration of the period of sojourn on March 13, 2018.
(b)an alien staying in Korea in breach of the obligation to carry a passport must always carry his/her identification card, such as a passport, to verify his/her identity.
Nevertheless, at around 03:50 on July 12, 2019, the Defendant was requested to produce identification cards from police officers on the front side of the 'B' restaurant Dolbuk-gun', but did not carry a passport, etc.
2.
