Defendants shall be punished by imprisonment for one year.

However, for two years from the date this judgment became final and conclusive against the Defendants.

Punishment of the crime

Defendant

A entered the Republic of Korea on November 9, 2014 with a short-term visit visa (C-3-9, the period of stay 90 days) and did not depart from the Republic of Korea on February 7, 2015, which is the expiration date of the period of stay. Defendant B entered the Republic of Korea on December 7, 2009 with a non-professional employment visa (E-9-2, the period of stay 3 years) and did not depart from the Republic of Korea on December 7, 2012, which is the illegal stay of Chinese nationality.

1. Defendant A

(a) Any foreigner violating the Immigration Control Act may sojourn in Korea within the extent of his sojourn status and sojourn period;

The Defendant entered the Republic of Korea on November 9, 2014, and stayed illegally on February 7, 2015, the expiration date of the period of stay, and was arrested on August 9, 2016 to the employees of the Incheon Airport Immigration Office.

Accordingly, the Defendant stayed in Korea without status of stay from February 8, 2015 to August 9, 2016.

나. 공문서위조 피고인은 2016. 5.경 울산 이하 불상의 장소에서, 모바일 메신저 ‘위챗’을 통하여 중국에 있는 성명불상의 외국인등록증 위조업자에게 피고인의 사진 1장을 전송하면서 외국인등록증을 만들어 줄 것을 부탁하고, 성명불상의 위조업자는 외국인등록증 형태의 플라스틱 카드에 외국인등록번호를 ‘D’, 성명을 ‘E', 체류자격을 ’비전문취업(E-9)', 발급일자를 ‘2016. 05. 26.’, 발행자를 '화성출입국관리사무소장"이라고 각 기재하고, 피고인으로부터 전송받은 사진을 인쇄하는 방식으로 외국인등록증 1장을 위조하였다.

Accordingly, the defendant forged a foreign registration certificate under the name of the head of the Dong Immigration Office, which is an official document, for the purpose of exercising in collusion with the above person who is not the above person
