1. The defendant shall pay 38,00,000 won to the plaintiff and 20% per annum from February 21, 2016 to the day of complete payment.

In addition to the purport of the whole argument in Gap evidence No. 1, even if the plaintiff was employed by the defendant from September 10, 2010 to February 6, 2016, it is recognized that the plaintiff did not receive wages of 35,07,890 won and retirement allowances of 2,922,110 won.

Therefore, the defendant is obligated to pay to the plaintiff 38,00,000 won in total of wages and retirement allowances and damages for delay calculated at the rate of 20% per annum from February 21, 2016 to the date of full payment, which is 14 days after the retirement date of the plaintiff. Thus, the plaintiff's claim is justified.
