A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 6, 2014, the Defendant was sentenced to the suspension of the execution of the imprisonment with prison labor for six months in the Suwon District Court for fraud, and the judgment became final and conclusive on August 14, 2014.

On March 24, 2010, the Defendant was sentenced to a fine of KRW 5 million for a violation of the Road Traffic Act (driving) at the Daejeon District Court on March 24, 201, and was notified by the same court on April 14, 2009 of a summary order of KRW 3 million for the same crime, etc., and is a driver of a passenger car.

1. On December 3, 2010, the Defendant violated the Road Traffic Act (driving without a license) (driving without a license) and driving the said vehicle at a section of about five kilometers from around 5 kilometers in front of a mutually unclaimed restaurant in Daejeon-gu, Daejeon to the front day of the Jeju-do, while under the influence of alcohol at a level of 0.053% of blood alcohol content, without obtaining a driving license on December 22, 2010.

2. When the Defendant was found to have driven a motor vehicle on the road before the front day of the foregoing temporary border and requested to present a driver's license from D who was in the position of the Daejeon East Police Station, the Defendant presented a first-class large driver's license for the East-dong Police Agency's East-gu to the Defendant who was in possession in advance, as if he were the Defendant's driver's license for the Defendant.

Accordingly, the defendant did not use official documents.

3. When the defendant was pointed out that his photograph and face of the above driver's license are different from that of the defendant at the time and place mentioned in the above paragraph 2, the driver's name as stated below is the victim's name under the phrase "F", "G", and "0.053%" are registered in the name column of the notification form of the result of the Police DDA Driving Control, and printed out the same in the blood alcohol concentration column, and the driver's name is stated below.
