Reasons
Basic Facts
The Plaintiff’s bid participation Korea Land and Housing Corporation (the Korea Land and Housing Corporation and the Korea Land and Housing Corporation were merged into the Korea Land and Housing Corporation on October 1, 2009; hereinafter “Korea Land and Housing Corporation”), which was ordered by the Korea Land and Housing Corporation (the “Korea Land and Housing Corporation”), was implemented on December 11, 2007. The Plaintiff participated in the instant bidding by organizing a joint supply and demand organization with Defendant 55% of share ratio and Defendant 45% of share ratio.
Plaintiff
In order to ensure cash liquidity and utilize idle human resources after being awarded a contract in the instant bidding, the Plaintiff requested that the Plaintiff “the Plaintiff, etc., hereinafter collectively referred to as “the Plaintiff, etc.”) receive a successful bid in the instant bidding,” and “the Plaintiff, etc., hereinafter collectively referred to as “the Plaintiff, etc.,” to the effect that “the Plaintiff, etc., can receive a successful bid in the instant bidding” around December 4, 2007.
Accordingly, in order to assist the plaintiff in other bidding by assisting the plaintiff, the Russian companies agreed to assist the plaintiff in the bidding of this case and to help the plaintiff in other bidding.
(2) On December 11, 2007, the bidding date of this case, the bidding date of this case, and the bidding date of this case, the bidding date of this case was delivered by the Plaintiff. The bidding date of this case was submitted by the Plaintiff.
According to the above methods, the inputs of the instant construction work are considerably higher than 3, 17, 18, and 24 out of the inputs of each construction work type (the average inputs of the relevant construction work type are 95.37% or 106.99%, and the average inputs of the other companies are 65.3% or 75.1%). The instant bidding participated by 53 companies, among them, 18 companies, including the Plaintiff.
