A defendant shall be punished by imprisonment for four months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On November 13, 2015, the Defendant violated the Road Traffic Act (Non-licenseless Driving) driving a car-type car, 25 passengers, without obtaining a large license, from the front side of the building located in the 4-lane 8-ro Seoul Eunpyeong-gu, Eunpyeong-gu, Seoul, to the front side of the road, which is located in the 361-ro, Eunpyeong-gu, Seoul, and the 200 meters away from the 200-meter section of the first class driver’s license to the front side of the mountain road.

2. On November 13, 2015, the Defendant: (a) around 10:25 on November 13, 2015, the Defendant: (b) was engaged in contact with the E truck drivened by D while driving a bus, such as the foregoing paragraph (1), on the street front of the 361st century of Eunpyeong-gu Seoul Metropolitan Government and on the street of the mountain intersection.

Therefore, it is difficult for the police officer to be subject to criminal punishment due to the fact of driving without a license, such as the above paragraph (1), after receiving a 112 report to the effect that the above traffic accident occurred, the G(53) belonging to the Seoul Western Police Station F District, and thus, it is difficult for the police officer to receive criminal punishment.

In order to grasp the circumstances of the accident, the Defendant, who was on the bus on which the police officer was on board the said police officer, was on board the said bus, again, called “I am at any time” to H, and as H said to the effect that “I am off a bus and throw off the bus,” the Defendant: (a) was able to drive the bus to a police officer; and (b) the Defendant was able to bring the above police officer on the bus to the bus, and (c) the Defendant was able to remove the clothes of the police officer in front of the outside line of the police officer.

Accordingly, the defendant assaulted a police officer to interfere with the legitimate performance of official duties concerning the dealing with traffic accidents.
