A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2015 Highest 222] On October 25, 2014, at the Defendant’s home located in Gangdong-gu Seoul Metropolitan Government CB01, the Defendant puts up a phrase “htp://caf.naver.com/Joint and several” on the Internet, stating that “it sells 5,000 won of cultural merchandise coupons to 44,000 won.” On the same day, the Defendant made a false statement as if the victim D had no intention or ability to sell the said cultural merchandise coupon while selling it normally.
As such, the Defendant, by deceiving the victim, received money of KRW 42,50 from the said victim to the Agricultural Cooperative (E) account in the name of the Defendant, and acquired money of KRW 42,500 from the said victim who believed the Defendant’s horses as true, and acquired money by means of the said method from October 25, 2014 to January 5, 2015, as indicated in the attached crime list, and acquired money of KRW 254,380 in total from the victims four times through the said method.
[2015 Highest 652] On December 30, 2014, the Defendant posted a letter on the Internet’s residence in Gangdong-gu Seoul Metropolitan Government DaB01, that “I sell 35,700 won a e-mailet multiplied by the e-mail sold from the e-mail,” and then made a false statement as if I sell the above e-mailet normally to the victim F, who reported and contacted the above writing, despite having no intention or ability to sell the above e-mail.
As such, the Defendant, by deceiving the victim, received money of KRW 35,700 from the victim to the new bank account (G) in the name of the Defendant, and acquired money of KRW 35,700 from December 30, 2014 to January 21, 2015, and acquired money totaling KRW 551,000 from the victims seven times in total by the same method as indicated in the attached crime list.

1. On December 30, 2014, the Defendant is a direct transaction site of the Internet in the Defendant’s residence located in Gangdong-gu Seoul Metropolitan Government.
