A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. 피고인은 2019. 5. 27. 00:35경 서울 강북구 B 앞길에서, ‘택시에 승차한 손님이 내리지 않고 욕설을 한다’라는 내용의 112신고를 받고 출동한 서울강북경찰서 C파출소 소속 경찰관인 D, E으로부터 택시요금 지불 및 하차를 요구받자 택시 조수석에 앉은 상태로 위 D를 향하여 주먹을 휘두르고, “내가 뭘 잘못했냐 이 씨발 놈들아, 나보고 뭘 어쩌라는 것이냐”라는 등의 욕설을 하며 계속하여 위 D를 향하여 발길질을 하고, 재차 하차를 요구하는 위 E의 가슴 부위를 주먹으로 1회 때리고 발길질을 하여, 112신고사건 처리에 관한 경찰공무원들의 정당한 직무집행을 방해하였다.
