피고인은 2012. 8. 16. 20:00경 서울 종로구 C고시원 418호 앞 복도에서 담배를 피우지 못하게 작은 유리창을 막은 나무 패널이 없어진 것을 발견한 피해자 D(여, 56세)가 “누가 나무 패널을 치웠어 ”라고 하자 “씹할 년아, 개 같은 년아, 이 똘아이 같은 년아, 나무 패널을 누가 버렸다는 거야.”라며 출입문을 주먹으로 때려 출입문에 피해자의 오른쪽 광대뼈 부위가 부딪히게 함으로써 피해자로 하여금 치료일수 미상의 찰과상을 입게 하였다.
