A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

1. Forgery of private documents;

A. On September 3, 2010, the Defendant forged a real estate sales contract: (a) stated the column for the location of the real estate sales contract form “Seoul, Gyeonggi-do, one parcel B, Dong 203, and one parcel B, and one parcel B, and two hundred and forty (240,000,000)” in the lower part of the sales price column; (b) stated “Seoul, Seocho-gu Era 202, F, and G” in the lower part of the seller column; and (c) stated “H 302, I, and J” in the lower part of the buyer column as “Seoul, Gangnam-gu, Seoul, H 302, I, and J”; and (d) affix the J’s seal arbitrarily affixed to the name.

Accordingly, the defendant, for the purpose of exercising rights and obligations, has forged one copy of a real estate sales contract in the name of G and J.

B. The Defendant entered “real estate transfer certificate” on the date, time, at the place specified in paragraph (1) of Article 1, at the computer network, and stated that the Defendant was “real estate transfer certificate” in the real estate display column, and stated under the name of the Defendant “J, I, and Gangnam-gu Seoul Metropolitan Government H” that it was “J, I, and that it was in possession of the same at will on the back of his name.”

Accordingly, for the purpose of exercising, the Defendant forged a certificate of assignment of real estate under the name of J, a private document on rights and obligations.

2. Around September 3, 2010, the Defendant: (a) submitted a forged real estate sales contract and a real estate transfer certificate to N, who is aware of the forgery, at the M office operated by L in K in Nam-si, Namyang-si; and (b) subsequently, exercised the above investigation document as if they were genuine.

3. On September 3, 2010, the Defendant, by deceiving the victim as if he were the document duly formed by presenting a forged real estate sales contract and a real estate transfer certificate to the victim N, at the M office located in K in Nam-si, Namyang-si, as described in paragraph (1).
