A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. Around March 31, 2010, the criminal defendant against the victim C made a false statement to the victim that "the victim's child-friendly Gu was promised to receive KRW 100,000 between the father at the high place of the Hancheon Group, who will pay KRW 4.6 million after three days if he/she borrowed KRW 4.6 million."

However, the father of the defendant was not an officer or employee of the Korean Commercial Group, and the defendant did not have any special property, and there was no certain income, so even if he borrowed money from the victim, he did not have an intention or ability to pay it.

The Defendant received 4.6 million won from the victim's parking lot in the above D around that time.

In addition, from around that time to September 28, 2010, the Defendant received a total of KRW 153,449,046 from the victim on 23 occasions as shown in attached Table 1 (i).

2. Around 16:00 on July 20, 2010, the Defendant made a false statement on the part of the victim E at a F store working for the victim E in the Boan comprehensive terminal located in Boan-si, Boan-si. In that sense, the Defendant loaned the victim the amount of KRW 20 million to G on July 20, 2010, and the Defendant extended the amount of KRW 27 million to the President of Boan-si. Therefore, the Defendant made a false statement on July 201, 200 to the victim, and the Defendant extended the amount of KRW 6.8 million to the police officer on July 2010.

However, in fact, the Defendant did not have any real estate leased to another person, and did not lend money to G, and did not have any special property, and therefore, there was no intention or ability to repay the money even if the Defendant borrowed money from the victim.

The Defendant received 6.8 million won from the victim to the bank account under H’s name.

In addition, the Defendant’s list of crimes is attached between that time and October 1, 2010.
