A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the operator of C corporation.

On 2011, the Defendant subscribed to the victim Samsung Fump trucks, E dump trucks, F dump trucks, and G dump trucks to the victim Samsung Fump Insurance Co., Ltd.

The defendant did not operate the dump truck as it applied for the suspension to the administrative office, and submitted the certificate to the victim with the issuance of the certificate, and received the refund of the premium paid to the victim by the method of filing an application for the refund of the automobile insurance premium.

On January 30, 2012, the Defendant applied for the suspension of construction machinery business to North Do on the street, and received the notification of the suspension of construction machinery business from North Do on the street. On March 3, 2013, the Defendant: (a) filed an application for suspension of the said dump truck from January 30, 2012 to October 25, 2012; (b) filed an application for suspension of the said dump truck; (c) filed a false notification of the suspension of construction machinery business; and (d) filed an application for the suspension of the said dump truck from January 30, 2012 to October 25, 2012; and (d) filed an application for the suspension of the said construction machinery business with H to prepare a written request for alteration of the automobile insurance; and (d) filed it with the victim.

However, the defendant operated the dump truck above.

The Defendant was refunded KRW 3,215,500 from the injured party on March 21, 2013.

In addition, the Defendant received the total premium of KRW 18,174,960 from around that time to November 7, 2014 by the same method eight times as indicated in the list of crimes in the attached Table.
