Punishment of the crime
[2] Defendant A was sentenced to imprisonment with labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) and for a violation of the Road Traffic Act (non-licenseed driving) on April 22, 2011; on June 7, 2011, Defendant A was sentenced to a fine of KRW 300,000 for a violation of the Road Traffic Act (non-licenseed driving) at the Cheongju District Court; on July 19, 2011, Defendant A was sentenced to a fine of KRW 30,000 for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) and a violation of the Road Traffic Act (non-licenseed driving) at the Cheongju District Court on May 14, 2014, and completed the execution of the sentence at the Cheongju District Court on May 6, 2017.
Defendant
B was sentenced to a fine of 100,000 won for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) and a crime of violation of Road Traffic Act (non-licensed driving) in the Chungcheong District Court on April 22, 2011, and sentenced to 10 months of imprisonment for a crime of violation of the Road Traffic Act, 2 years of suspended execution, and 200,000 won for a crime of violation of the Road Traffic Act. On November 16, 2012, the Daegu District Court was sentenced to imprisonment for larceny and 1 year and 2 months for a crime of larceny, and on October 23, 2014, was sentenced to 6 months of imprisonment for an attempted crime of larceny from the Cheongju District Court Branch Branch on April 24, 2015. On June 5, 2015, the Cheongju District Court was sentenced to a fine of 100,000 won for a violation of the Road Act (non-licensed driving) and executed the prison on March 21, 21.
[Criminal facts]
1. On September 26, 2017, at around 15:30 on September 26, 2017, the Defendants committed the joint crime committed by the Defendants: (a) in the victim E’s house located in Chungcheongnam-gun, Chungcheongnam-do, divided the first race and intruded into the victim’s house; (b) continuously Defendant B opened the front window behind the victim’s house and opened the house to the house; and (c) Defendant A intruded into the victim’s house through the front door, and was in the cell room room.
