A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. 사기 및 컴퓨터 등 사용 사기 C은 2015. 4. 중순경부터 중국 내 보이스 피 싱 범죄조직 총책인 성명 불상자( 일명 ‘D’, 위 쳇 명 ‘E’ )로부터 보이스 피 싱 범죄에 사용할 속칭 대포 통장과 체크카드 등을 통장 모집 전달 책으로부터 양수 받은 후 이를 이용하여 대포 통장에 입금되는 사기 피해금액을 인출한 뒤 위 성명 불상 자가 지정하는 계좌로 입금해 주는 소위 ‘ 인출 총책’ 을 맡아 주면 인출금액의 5%를 수수료로 주겠다는 제의를 받고 이를 승낙하였고, 피고인과 F, G, H, I, J 등은 위 C으로부터 일당 25만 원에서 45만 원을 지급 받기로 하고 현금 지급기에서 피해대금을 인출하는 ‘ 인출 책 ’으로 일하기로 하였다.

Around April 29, 2015, the person under whose name the victim was not eligible for a loan from the victim K, the said person called the victim K to “a remittance of KRW 3,60,000,000,000,000,000,000,000,000,000.”

However, the above person who is not the victim's name only makes such a false statement in order to obtain money from the victim, but did not have the intent or ability to repay the existing loan of the victim and to make a substitute loan even if he/she receives money from the victim.

위 성명 불상자는 위와 같이 피해자를 기망하여 이에 속은 피해 자로부터 같은 날 국민은행 계좌로 360만 원을 송금하게 하고, 피고인을 포함한 인출 책들은 같은 날 ‘ 위 챗’ 을 통해 피해 금이 입금되었다는 연락을 받고 위 금원을 인출하였다.

Accordingly, the Defendant, in sequence, conspireds with C, F, G, H, I, J, and the above-mentioned name in order to acquire KRW 3.6 million from that time. From that time, from that time to May 11, 2015, 321,291,15 won in total from 38 victims, such as the written list of crimes (1) in attached Form 114 times until May 11, 2015, and by deceiving victims.
