Facts of recognition

The Defendant (Appointed Party; hereinafter referred to as the “Defendant”), the designated parties, and the co-defendants of the first instance trial are the successors of M, who are owners on the register of K K-source 79 square meters (hereinafter referred to as the “instant real estate”). The Plaintiff is the owners of 7/8 shares of 00 square meters (hereinafter referred to as “O land”) adjacent to the instant real estate in Seopopo-si, Seopopo-si.

On April 23, 1992, the plaintiff's mother L, M, P completed the land division procedure on part of the land owned by each party.

After dividing the lot number of the real estate before the division, the owner in the registration register of the real estate in Seopopopo-si, Qupo-su 39 square meters in Seopo-si, Seopo-si, Seopopo-si, Qupo-si, Qupo-su 79 square meters in Seopo-si, Sinpo-si, Sinpo-si, Kapo-si, Tri-si, U-su 70 square meters in Seopo-si and M issued a certificate of personal seal for sale of real estate with the other party as the purchaser of real estate on September 29, 192. P also issued a certificate of personal seal for sale of real estate with the same date

The boundary of the instant real estate and Seopopopoposi S land is divided into stone fences and trees. L and the Plaintiff have used the instant real estate as an access road to the instant land from the time of such division to the time of such division.

The plaintiff completed the registration of ownership transfer on the O's land on December 17, 2004 due to sale on December 16, 2004.

M A. M died on March 2, 200, and on June 23, 2005, N, the inheritor, was deceased on June 23, 2005, and finally succeeded to M’s property as indicated below.
