3. 피고인은 2019. 7. 23. 06:58경 서울 강동구 B건물 앞 노상에서 F 등 불특정 다수의 행인이 지켜보는 가운데 쭈그리고 앉아 바지와 팬티를 내리고 성기를 외부로 노출한 상태로 손으로 잡고 흔드는 방법으로 자위행위를 하였다.
