Punishment of the crime

Defendant

On May 1, 2018, A was sentenced to one year by imprisonment with prison labor, and on May 1, 2018, Defendant B was sentenced to ten months by imprisonment with prison labor for the obstruction of the exercise of rights at the District Court of Jung-gu on May 1, 2018, and the judgment became final and conclusive on May 9, 2018.

Defendant

A is the representative director of corporation D, the purpose of which is to suspend manufacturing and selling water, and the defendant B is the management director of the corporation.

On September 21, 2015, when the Defendants received a loan of KRW 100 million from the Korea Development Bank in the name of the above company, the Defendants provided the victim with a security right to transfer the claim amounting to KRW 120 million with the maximum amount of the claim amount of KRW 120,000,000, which is the object of 7 machinery, such as the market price in the company's business place, automatic shock and packing machine.

A, on August 2017, when the operation of the above company was difficult to pay interest to the victim because it was difficult to operate the company, A established a new water Schlage manufacturing corporation in the name of E, an employee of the above company, with intent to transfer the above machinery to the said place of business and to continue its business in the name of the said corporation, and ordered Defendant B to establish the corporation and replace the machinery as above.

B, around August 8, 2017, in accordance with Defendant A’s instruction, established the legal entity of G, a corporation, the representative director of which is E, in F, a corporation, with the representative director of E, and subsequently, around August 17, 2017, the relationship between the transfer of one of the Mask automatic shock and packaging machine to the business establishment of the said legal entity is unclear, and the victim was concealed by concealing the location of the said machinery.

As a result, the Defendants conspired to conceal the above machinery owned by D Co., Ltd. which was the object of the victim's right and interfered with the victim's exercise of right.
