1. The judgment of the first instance, including the Plaintiff’s appeal and the claim extended by this court, shall be modified as follows.

1. The summary of the case and the facts premised on the case

A. The summary of the instant case is a matter for which the Plaintiff seeks a judgment of execution on the basis of the judgment rendered on October 30, 2009, rendered by the U.S.Tex Eastern District Court Support for the Defendant.

The judgment of the court of the first instance accepted excessive amount of damages, and if the defendant is a Korean legal entity and the judgment of the court of the United States is approved as it is, the defendant is highly likely to go bankrupt, the court of the first instance allowed compulsory execution against some of the judgments of the court of the United States of America (US$ 9,109,278.5) and dismissed the plaintiff's remaining part of the judgment, and the plaintiff and the defendant appealed against their lost part of the judgment.

전제된 사실관계 【증거】갑1, 갑2의 1, 2, 3, 4, 갑5, 6, 7, 을1, 을4의 1, 2, 3,과 변론 전체의 취지 ⑴ 당사자 ㈎ 원고는 지폐, 동전, 수표 등을 계수ㆍ분류ㆍ인증하는 기계의 제조 및 판매업 등을 목적으로 하는 미국 법인이다.

㈏ 피고는 금융자동화기기 개발ㆍ제조 및 판매업 등을 목적으로 하는 대한민국 법인으로 2007. 3. 24. 지폐계수기 생산 및 판매업을 하던 ㈜신우아이티(이하, ‘㈜’는 생략한다)를 합병하였다.

⑵ 외국법원의 확정판결 ㈎ 원고의 미국 특허권 원고는 지폐 계수 및 위조지폐 탐지의 방법 및 장치에 관하여 다음과 같은 미국 특허권을 가지고 있다

(1) Registration number 6,459,806 of the Plaintiff's U.S. patent right: 6,459,806 patent: A variety of face values are automatically identified using the luminous characteristics of the sign printed on paper, and "patent 806" is called "patent for calculating equipment and method."

(2) Patents 5,966,456 of registration number 5,96: Trastus (sstk) and par value is rapidly identified and the authenticity of paperis.
