A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On September 16, 2010, the Defendant stated that, at the office of the branch office of the DDR E Co., Ltd. located in the Dong-gu Busan Metropolitan City, the victim F, “I wish to lend KRW 1 million to the taxi engineer, respectively, in consideration of the fact that there is no concern that people who have worked for a long time are able to receive retirement allowances, and if the Chairperson lends money, I will assist in the next election with a seal. If the Defendant borrowed KRW 5 million, 10% interest shall be added up until October 16, 2010.”

However, in fact, the defendant did not lend money to the taxi company, but did not want to pay his personal debt to the defendant. Since he borrowed money to use it for election expenses, there was a debt of 30 million won or more, and even if he borrowed money from the victim, he did not have the intention or ability to pay it on the agreed date.

As such, the Defendant, by deceiving the victim, received 4.5 million won from the victim in the same place, and acquired it by fraud.

2. On September 27, 2010, the Defendant called the victim F in Busan to the effect that “If one taxi engineer lends more than one million won to one taxi engineer, 15% interest shall be added until October 16, 2010.”

However, the defendant did not have the intention or ability to pay the money on the agreed date even if he borrowed the money from the victim as stated in Paragraph 1.

As such, the Defendant, by deceiving the victim, received 850,00 won from the victim to the largest net account.

3. On September 29, 2010, the Defendant stated that “The election cost is required to run in order to run an election for the head of the taxi labor union in the Busan-gu G office, Busan-gu, Busan-do. If the Defendant borrowed KRW 10 million to the victim, he/she shall be repaid up to October 29, 2010.” If he/she lends money, he/she may have the right to print or set up a coffee.”
