1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The following facts may be found either in dispute between the parties or in full view of the entries in Gap evidence 1, 3, 2 and 4-1, 2, and 1-2, and the entire purport of the pleadings as a result of the examination by this Court.
(1) On February 22, 1973, the land category was changed to miscellaneous land in the Guri-si, Guri-si, the 315 square meters prior to the division of the 315 square meters prior to the division.
(2) On February 22, 1973, Guri-si C Miscellaneous land 315 was divided into 285 Guri-si C Miscellaneous land 285 and 30 Guri-si B Miscellaneous land 30.
(3) On February 22, 1973, the land category was changed to a road on February 22, 1973, the B 30 square meters prior to the division was 9 square meters (30 square meters) of the Guri-si B road prior to the division.
(4) With respect to the Guri-si B road 99 square meters prior to the division, each ownership transfer registration was completed on July 4, 1976 in the name of D, October 18, 1984, in the future of EF, January 29, 1986.
(5) On November 25, 1980, a report on the implementation of division rearrangement under the former Land Readjustment Project Act was made with respect to B road No. 99 square meters prior to the division.
(6) On January 12, 1987, B of the Gu-si B road prior to the subdivision was divided into 46 square meters of the Gu-si B road (hereinafter “instant road”) and 53 square meters of the Gu-si H road (hereinafter “H land”).
(7) With respect to the instant road and H land, the registration of ownership transfer was completed on June 22, 1989.
B. On July 21, 201, the Plaintiff’s acquisition of ownership of the instant land (1) completed the registration of ownership transfer by the subrogation of the court of execution following a provisional attachment application filed by the deceased I against J on July 21, 201, and the compulsory auction procedure began.
(2) On May 8, 2012, the Plaintiff acquired ownership by receiving a successful bid in the process of compulsory auction and paying the price.
C. The instant roads are located in urban areas and Class II general residential areas as determined by the National Land Planning and Utilization Act, and are located in front of part of roads and neighboring neighborhood living facilities.
