1. The Defendant’s decision to collect unjust enrichment of KRW 11,077,080 against the Plaintiff on September 27, 2018 exceeds KRW 1,881,55.
Reasons
1. Details of the disposition;
A. The Plaintiff is a former taxi driver belonging to B Co., Ltd.
On February 25, 2016, at around 01:35, the Plaintiff was faced with the E-traffic patrol vehicle operated in violation of the signal at the above intersection in order to avoid the inspection by D, a police officer belonging to the Kim Sea Police Station, and to attract the vehicles that escape, while driving a C taxi and making a left-hand turn at the intersection of treatment apartment distance of 121 located inside and outside the city of Kimhae-si, the Plaintiff was faced with an accident.

In the instant accident, the Plaintiff was diagnosed as “in the event of the instant accident the blood transfusions in the outer two parts, damage to less than the number of fingers, pulmonary pulmonary pulmonary pulmonary pulmonary humconium, pressure humconium, pressure humconium, the frame of the pelke, and the frame of the walls under the inner humconium, island, language disorder, and pumconium” (hereinafter “the instant injury”). The Plaintiff received medical care from the Defendant.
C. On May 13, 2016, the Plaintiff filed a lawsuit with F Co., Ltd. (hereinafter “F”) seeking damages from the instant accident with Busan District Court Decision 2016Da318305 (hereinafter “instant civil case”). On May 29, 2018, F Co., Ltd. (hereinafter “the instant civil case”), the said court: (a) deducted the Plaintiff from the Plaintiff’s lost profit KRW 97,782,220 (However, the Plaintiff’s total temporary layoff benefits paid by the Defendant amounting to KRW 37,341,510); (b) on or after April 11, 2018, 93,848,830, subsidized expenses, KRW 3,68,436, KRW 257, KRW 360, KRW 480, KRW 780, KRW 4680, KRW 2780, KRW 5780, KRW 2085, KRW 4687,2075,20750.
F The appeal was filed by Busan District Court 2018Na50222, but the above court filed an appeal on October 5, 2018.
