A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On January 27, 2013, the Defendant: (a) starting from the “mastal station” located in the Magjin-gu Magjin-gu Magdong, Seongdong-gu, Seoul; and (b) cut off the victim’s cell phone with one cellular phone with an amount equivalent to KRW 8.550,000,00,000 in the market price owned by the victim who is placed in the victim’s side of another victim, who was placed in the gap in which the victim B locked, was located in another victim’s seat; and (c) one credit card card of a new bank.
2. Violation of the Specialized Credit Financial Business Act, and fraud;
A. On January 27, 2013, around 06:53, the Defendant, at the D convenience store located in Sungnam-si, Sungnam-si, calculated the price of one sandd position equivalent to the total market value of KRW 4,500, one fryer vehicle, one drinking water, etc., and issued the foreign exchange bank physical card (credit card number: E) that was stolen under paragraph (1) as if he were a legitimate holder, and had an employee pay the said payment, thereby using the stolen debit card and acquiring the pecuniary profit equivalent to KRW 4,500.
B. On January 27, 2013, the Defendant: (a) around 06:55, at G convenience stores located in Sungnam-si F, Sungnam-si; (b)
In the same manner, it used stolen debit cards by settling payments of one drinking water and two hand cans equivalent to the total market value of 8,500 won, and acquired property profits equivalent to 8,500 won.
C. On January 27, 2013, the Defendant, at the inn of “I” located in Sungnam-gu, Sungnam-gu, Sungnam-gu, Seoul, at around 07:11, Ga.
In the same way, it used a stolen debit card by settling the amount of 37,000 won, and acquired financial benefits equivalent to 37,000 won.
around 07:54 on January 27, 2013, the Defendant is at K convenience points in Sungnam-siJ around 07:54, Ga.
In the same way, it used a stolen debit card by settling payments such as 10,300 won, 1, 1, and 1,000 won in total, and acquired property profits of 10,300 won.
3. Embezzlements of lost possession; and
A. On July 2010, the Defendant is in the Myeonkdong, Jung-gu, Seoul.
