1. The defendant shall be punished by imprisonment for one year;

2. The Defendant shall be an applicant C to compensate for the amount of KRW 90,000,00.

Punishment of the crime

On November 27, 2014, the Defendant was sentenced to one year and two months of imprisonment with prison labor at the Changwon District Court for fraud, etc. on November 27, 2015, and completed the execution of the sentence at the Changwon Prison on November 2, 2015. On May 12, 2015, the Defendant was sentenced to four months of imprisonment with prison labor and one year of suspended execution.

On December 6, 2015, the Defendant posted a letter on the Internet site of the “Neman’s Republic of Korea” on the PC located in the Geumcheon-gu Busan Metropolitan Government, and made a false statement to the effect that the Defendant would inform the victim D who reported and contacted with the fact that he would deposit money to the Defendant’s account, of the fin number of cultural merchandise coupons.

However, there was no intention or ability to send cultural merchandise coupons even if the money is remitted from the injured party.

Defendant deceiving the victim as above and received KRW 80,000 from the victim’s account (Account Number: E) in the name of the Defendant, and acquired KRW 4,392,50 in total over 108 times from December 6, 2015 to March 9, 2016 by the following methods: (a) from around December 6, 2015 to around March 9, 2016:

On December 1, 2015, the Defendant posted a letter to the effect that cultural gift certificates are sold at the PC room located in Geumcheon-gu Busan Metropolitan Government, on the Internet site of the NAVER, and made a false statement to the effect that if money is deposited to the Defendant’s account to the victim F, the Defendant would be informed of the fin number of cultural gift certificates.

However, the defendant did not have the intention or ability to send cultural merchandise coupons even if he has received the above money from the injured party.

The defendant deceivings the victim as above and receives 60,000 won from the new bank account (Account Number: G) in the name of the defendant on the same day from the victim, as shown in attached Table 2.
