Acquittal of the accused shall be acquitted.
Reasons
1. Around the beginning of March 2013, the Defendant: (a) reported a letter of the charge that grants KRW 50,000 per head of the Tong, if he/she transferred a passbook, e-mail card, etc. on the Internet NAB bulletin board; and (b) opened and transferred the passbook.
Around that time, the Defendant transferred a new bank account (Account Number: C), a community credit cooperative account (Account Number Non-Account Number), a agricultural cooperative account (Account Number Non-Account Number) and a bank account, and a means of access used in the electronic financial transaction by transferring a name non-resident to another person.
2. Determination
A. On February 12, 2014, the Defendant received a notice of KRW 5 million with a summary order of approximately 2014 high-end 453 on February 12, 2014, and on March 19, 2014, the above summary order was finalized on March 19, 2014. The criminal facts of the above summary order were as follows: “The Defendant issued the Nong Bank account (Account Number: D), a new bank account (Account Number: C), a new Saemaul Depository account (Account Number: E) and four cash cards, etc. under the name of the Defendant on March 19, 2013.”
B. Meanwhile, on March 8, 2013, the Defendant opened one account with a new bank. On March 8, 2013, the training Saemaul Fund opened one account with the said bank on March 8, 2013, and on March 7, 2013 (the remaining accounts opened with the Nonghyup Bank are deemed irrelevant to the facts charged in the instant case in light of the time of its establishment). At that time, the Defendant received KRW 300,000 in return for the delivery of passbooks and received additional payments. There is no other data to receive payment.
C. In comparison with the facts constituting the above summary order and the facts charged in this case, the new bank account is the same account. The name of the Nonghyup Bank and the Yeonsu Saemaul Bank are the same, and the number of issued accounts is four. The same shall also apply to the time and place of issuance.
