A defendant shall be punished by imprisonment for a term of one year and four months.

Seized evidence Nos. 1 and 2 shall be confiscated from the accused.

Punishment of the crime

위 챗 대화명 'D' 등 성명 불상자들은 속칭 ‘ 보이스 피 싱’ 범죄를 하기 위하여 유인책, 계좌 및 현금카드 모집 책, 인출 책 등 여러 단계를 조직하고 유인책에 속하는 자들은 불특정 피해자에게 저금리 대출을 받기 위해서는 기대 출금 채무를 상환하여야 한다고 하거나 대출을 받기 위하여는 지급보증 보험료를 납부하여야 한다고 속여 미리 모집한 계좌로 돈을 이체하도록 하고, 인출 책은 이를 인출하여 전달하는 방법으로 돈을 편취하기로 계획하였다.

피고인은 2018. 1월 중순경 성명 불상 자로부터 체크카드를 대여해 주면 돈을 주겠다는 문자 메세지를 받고 성명 불상자에게 연락하였다가 위 챗 대화명 'D '를 사용하고 자신을 ‘E’ 이라고 사칭하는 자로부터 택배 1건 당 5만 원을 줄 테니 해보라는 제안을 받고, 2018. 1. 31. 그 일이 보이스 피 싱 범죄라는 것을 알고도 돈을 벌기로 마음먹고 위 보이스 피 싱 조직의 현금카드 전달 및 인출 책으로 가담하기로 순차 공모하였다.

1. Fraud;

(a) On February 9, 2018, a person who is not registered singing employee may receive a loan of KRW 24 million at the interest rate of 8% per annum when he/she pays the existing loans in mountain and singn, by telephone to the victim F.

G made a false statement to the effect that the national bank account (H) in the name of G would deposit KRW 5 million.

However, the above Bosing employee did not have any intention or ability to make a loan at an annual interest rate of 8% even if he receives the money from the injured party.

At around 15:51 on the same day, the victim transferred KRW 5 million to the national bank account in the above G name.

On February 9, 2018, the Defendant was in possession of the Defendant at a same station in the territory of the KB National Bank, Dong-dong, 109, Dong-dong, Dong-dong, Dong-dong, 109.

The amount of KRW 200,000,000, which was withdrawn five times with the national bank card in the name of G, shall be the shares of the next 200,000 won.
