A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

No person, other than a person handling narcotics, shall trade, assist in the trade of, give or receive, possess, possess, use, control, prepare, administer, or provide psychotropic drugs or other psychotropic drugs containing their substance.

The defendant is not a person handling narcotics.

1. 2019. 4. 4.경 범행 피고인은 2019. 4. 4. 06:00경 경주 B에 있는 OO사우나 앞에서, 스마트 채팅 어플 ‘즐톡’으로 향정신성의약품인 ‘졸피뎀’ 성분이 포함된 ‘스틸녹스’ 약품을 판매하는 C에게 현금 7만원을 주고 ‘스틸녹스’ 4정을 구매하였다.

2. On April 13, 2019, around 13:20 on April 13, 2019, the Defendant: (a) purchased at the place prescribed in paragraph (1) 1,10,000 won in cash to the said C; and (b) purchased ethyl 11,00, including psychotropic drug ingredients.

3. On April 27, 2019, around 14:00 on April 27, 2019, the Defendant, at the place prescribed in paragraph (1), purchased ethyl 10,000 won in cash to the said C and purchased ethyl 10,000 won including psychotropic drug ingredients.

Accordingly, the Defendant sold a stroke-mm, which is a stroke-type drug at a total of three times.
