1. The Defendants are to the Plaintiff:
(a) Of the lands listed in paragraph 3 of the attached list, each point of the Attached Form Nos. 1, 2, 3, 4, and 1.
Reasons
1. Basic facts
A. The Plaintiff is the owner of the land listed in paragraph (1) of the attached Table of Real Estate List (hereinafter “C Site”), and the land listed in paragraphs (2) and (3) of the same Table (hereinafter “D ditches”) is owned by the Republic of Korea. The land listed in paragraph (3) is the land owned by the Republic of Korea.
B. The Defendant B was originally the owner of the C site and its ground building (50.51 square meters, each of 50.51 square meters and 11.31 square meters, each of the 1,2, and 3th floor of reinforced concrete building building in the register). The said site and building was expropriated based on the Act on Acquisition of and Compensation for Land, etc. for Public Works (hereinafter “Land Compensation Act”) for the Plaintiff’s F Road Packing business (hereinafter “instant expropriation”), and on June 11, 2009, the ownership transfer registration under the Plaintiff’s name was completed.
C. At the time of the acceptance of the instant case, there were parts of the building without permission, other than the registered parts, as seen above. However, the remaining parts after the acceptance of the instant case, which were partially voluntarily removed by the Defendants, are the 1-A, b, c, storage and temporary structures, and the 3-story neighborhood living facilities with the third floor roof of reinforced concrete structure (hereinafter collectively referred to as the “existing building”).
After the acceptance of the instant case, the Defendants: (a) constructed a stairs room on the ground of 15 square meters on the part of “a” in the ship connected with each point of 36,35,34,39, and 36 in sequence among the DNA ditches owned by the State; and (b) constructed a stairs room on the ground of 15 square meters on the part of “a” in the attached Form No. 37,38,39 square meters among the 16,35, 34, 39, and 169 square meters of the adjacent drawing among the 16,35, 36 square meters of the attached drawing among the ditches owned by the State; and (c) installed two square meters of “a car” portion in the attached Form No. 21,22,23,24,26,27,28,29, 38, 37, 37, and 36 of the said G road in sequence; and (d) annexed Table No. 21,000.
