Punishment of the crime
[2] In using and managing a means of access (Defendant A and B), no person may borrow, lend, keep, deliver or distribute a means of access while receiving, demanding or promising any compensation, unless otherwise specifically provided for in any other Act.
1. Around January 20, 2015, the Defendant issued a passbook and cash card connected to B’s new bank account in the name of GPC bank account (Account Number H) prior to the GPC bank account located in Gyeonggi-si, around January 29, 2015, to B, which was proposed to the effect that “The Defendant will offer KRW 500,000,000 to use the passbook for 5 or 6 months.”
As a result, the Defendant promised to borrow a means of access for electronic financial transactions.
2. On January 20, 2015, Defendant B received a proposal from A to the effect that “A will offer KRW 500,000,000 to use the passbook for 5 or 6 months.” On January 29, 2015, the Defendant issued a passbook and cash card connected to A’s new bank account (Account Number H) in the name of the Defendant prior to GPC bank located in GPC bank located in Gyeonggi-si, Gyeonggi-do.
Accordingly, the Defendant loaned the means of access for electronic financial transactions at the request of compensation.
