1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
Comprehensively taking account of the respective descriptions of evidence Nos. 2 and 3, evidence Nos. 5-1 and 2 as well as the overall purport of the arguments as a result of the appraisal by appraiser E, it can be acknowledged that the land Fran-gu Seoul Metropolitan Government (hereinafter referred to as the “Plaintiff’s land”) and the building on land are owned by the Plaintiff. The Defendants’ land and the building adjacent thereto are owned by the Defendants, and the land in dispute of this case among the Defendants’ land is in contact with the Plaintiff’s land.
The plaintiff purchased the plaintiff's land and the building on June 1, 1979 and occupied the land of this case in a peaceful and openly recorded manner with the intent to own the land of this case from that time. Thus, the prescriptive acquisition on June 1, 1999 passed by 20 years, and therefore, the defendants are liable to implement the procedure for the registration of ownership transfer on the land of this case to the plaintiffs for the completion of the prescriptive acquisition.
On June 1, 199, even if the Plaintiff occupied the land in this case, as alleged, and completed the prescriptive acquisition on June 1, 1999, the possessor of the land, the prescriptive acquisition period of which expires, is limited to holding a claim for ownership transfer registration on the ground of prescriptive acquisition against the land owner at the time of the expiration of the prescriptive acquisition period, and the person who newly acquired the ownership of the land after the expiration of the prescriptive acquisition period may not be asserted for the prescriptive acquisition (see, e.g., Supreme Court Decision 89Meu1305, Apr. 9, 191). According to the evidence No. 3, H, the heir of G, who owned the land in this case, sold it to I and completed the ownership transfer registration in the future of I on September 30, 203. Since the ownership transfer registration on each one/2 shares of the land in this case, the Plaintiff may newly recognize the ownership transfer registration on each of the said land in this case for the Defendants’ future after the prescriptive acquisition period expires.
