A shall be punished by a fine of KRW 3 million, and each of the defendant B and the defendant C shall be punished by a fine of KRW 5 million.

B The representative director of C, a corporation, the purpose of which is to carry out the ocean waste collection business and the deposited pollutants collection business in Gyeongnam Kim-si, and C, a corporation, the purpose of which is to carry out the business of collecting wastes using the above ship by leasing the sale-based F (F, 1,355t Cargo Line) from E, and the defendant A is a person employed by C as the captain of the above F as the captain.

1. The captain of a defendant A may not call at a non-open port or transport passengers or cargo between domestic ports without the permission of the Minister of Maritime Affairs and Fisheries, other than Korean vessels;

Nevertheless, on December 1, 2017, the Defendant, at the 14-day sea (35do34 minutes north, east 125Do50 minutes east 125do 120 minutes east 125do 50 minutes) northwest-do, west-do, west-gun, west-gun, west-gun, west-gun, west-gun, west-do, the west-do head of the non-open port, resisted the above F, who is the Republic of Korea, without obtaining permission

2. Defendant B

(a) A person who intends to occupy or use public waters in violation of Acts on the management and reclamation of public waters shall obtain permission to occupy or use public waters from the management authority of public waters, as prescribed by Presidential Decree;

Nevertheless, the Defendant, from around 13:00 on December 1, 2017 to around 13:30 on the 3rd day of the same month, did not obtain permission for occupying and using public waters from the Cheongan-gun Office, which is the managing authority, to remove scrap iron by lifting the sunken vessel from the 14-day sea (the 35-34-minute, east 125-50-east, east 125-50-east) southwest-do, west-do, west-do, Northwest-do, the lower court: (1) from around 13:0 of the same month; (2) from around March 30, 2018 to April 6, 2018; and (3) from around the west-si, the Defendant did not obtain permission for mooring the vessel to F and collecting the vessel from the Cheongan-do Administration.

(b) Any person who intends to engage in the business of collecting sea wastes in violation of the Marine Environment Management Act shall be the Minister of Oceans and Fisheries or the Minister;
