A Imprisonment for a year and six months, defendant B and C shall be punished by imprisonment for a year and one year, respectively.

Defendant
A, either China, or China, is a captain in charge of the operation and fishery activities of E (the above vessel of 47 tons or more, hereinafter referred to as “the above vessel”), which is a type of fishing vessel of the same concurrent shipments, and Defendant B is an engineer in charge of the affairs, such as assisting the captain of the above vessel, helping the steering of the above vessel, and guiding the steering net of the fishing gear. Defendant C is an engineer in charge of the affairs, such as assisting the captain of the vessel as China, managing engine engines and oil so that the above vessel can navigate safely and facilitate fishery activities, and smooth operation of the vessel’s engine.
A foreign vessel may navigate in the territorial sea of the Republic of Korea without prejudice to peace, public order or security of the Republic of Korea, to the extent that such navigation does not impair peace, public order or security of the Republic of Korea, and when a foreign vessel engages in fishing at the time of passage, it shall be deemed to impair peace, public order or security of the Republic of Korea, and no crew member of a foreign vessel or other passenger shall violate such prohibition
Nevertheless, the Defendants conspired with each other on April 1, 2016, at around 09:00 of the Republic of Korea, to have three seafarers on board the said vessel under the same paragraph of the same paragraph of the same paragraph, and to have a type of net fishing gear loaded on the port and to have it operated.
