A defendant shall be punished by imprisonment for two years.

When seized Samsung Tallon ju (No. 3) is confiscated, one of the A7 mobile phones (No. 3) shall be confiscated.

Punishment of the crime

[criminal records] On July 16, 2015, the Defendant was sentenced to two years of imprisonment for fraud, etc. at the Jeonju District Court on July 16, 2015, and on August 13, 2016, the execution of remaining sentence was exempted in the Jeonju prison.

[2] On May 15, 2017, the Defendant sent a false statement to the effect that “one-eight net wheelchairs wheelers inserted” posted by the victim D, to the effect that “one-eight (18) net wheelchairss are sent to the victim,” and that “one-eight (18) net wheelchairss are sold to the victim” was sent by the victim D.

However, the defendant did not have a net wheelchairs so that he did not have any intention or ability to send money even if he received money from the injured party.

As such, the Defendant, by deceiving the victim and receiving 420,000 won from the victim’s personal compromise account under the name of the Defendant, as the price for the goods, received from the victim, from that time until January 11, 2018, an amount equivalent to KRW 11,07,00 in total of 43 times as shown in the list of crimes in the attached Table (1) from the victims, from that time to January 11, 2018.

On April 11, 2017, the Defendant made a false statement to the effect that “The Defendant sent money for the sale of LG TV” by communicating the victim with “the purchase of LG TV,” posted by the victim J, by visiting the victim, by using a computer at the French site on April 11, 2017.

However, the defendant did not have any intention or ability to send money even if he received money from the damaged party because he did not have any LGTV.

The Defendant, by deceiving the victim as such, received KRW 520,00 from the victim’s personal compromise account under the name of the Defendant on the same day, and received KRW 2,071,00 from the victim to May 23, 2017 total sum of the price of goods for ten times as shown in the attached crime list (2) from the victim to May 23, 2017.
