A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

1. Fraud;

A. On October 6, 2016, the Defendant stated that AK paid the cost of a mobile phone via a mobile phone and paid KRW 100,000 to AK at a bus terminal located outside the city in Seocho-gu Seoul Special Metropolitan City, Seoul Special Metropolitan City. The Defendant consented AK to open a mobile phone in its name.

On October 6, 2016, the Defendant, along with AK, filed an application for opening two mobile phones (N and AO) in the name of AK in the name of AK at Jeonju City, and around October 13, 2016, the Defendant filed an application for opening one mobile phone (AP) in the name of AK with the said AM agency.

However, even if the defendant opens a mobile phone in the name of AK, he was well aware that AK would not pay AK's mobile phone price or charge according to the plan to sell the mobile phone with a heavy mobile phone, and there was no intention or ability to pay the mobile phone price or charge to the defendant or AK.

As such, the Defendant, by deceiving the staff in charge of AM, obtained the issuance of three mobile phones (N, AO, and AP) equivalent to the sum of 2,783,700 won from the employees belonging thereto.

B. On November 28, 2016, the Defendant told Q Q to the effect that “A shall pay for a mobile phone via the opening of a mobile phone and pay KRW 100,000,000,000 to him/her,” and Q accepted the opening of a mobile phone in his/her name.

On November 28, 2016, the Defendant applied for the opening of three mobile phone terminals (AR, AS, and AT) to AM agencies located in AL at the Jeonju City, along with AP around 20:00.

However, even if the defendant opens a mobile phone in the name of Q, he was well aware that Q would not pay the mobile phone price or charge according to the plan to sell the mobile phone using a mediumphone, and there was no intention or ability to pay the mobile phone price or charge to the defendant or Q.
