The defendant's appeal is dismissed.
Reasons
1. The abstract of the grounds for appeal does not inflict any bodily injury on the victim;
2. In light of the difference between the first instance court and the appellate court’s method of evaluating the credibility of a statement made by a witness of the first instance court in light of the contents of the first instance judgment and the evidence duly examined by the first instance court, or the first instance court’s determination on the credibility of a statement made by a witness of the first instance court is clearly erroneous in light of the contents of the first instance judgment and the evidence duly examined by the first instance court, or the first instance court’s determination on the credibility of a statement made by a witness of the first instance court is clearly unreasonable in full view of the results of the first instance court’s examination and the results of additional evidence examination conducted until the closing of arguments in the appellate court, the appellate court does not reverse the first instance judgment on the ground that the first instance court’s determination on the credibility of a statement made by a witness of the first instance court differs from the appellate court’s determination (see, e.g., Supreme Court Decision 2011Do5313, Jun. 14, 2012).
In the process of dividing talks between the defendant and the door, the defendant has been trying to avoid the position by enhancing the speech and obsing and beling, and the defendant was pushed down with the shoulder and blue part, and was treated at the hospital due to the excessive elb and knee.
In order to get off the cell phone from the defendant and report it to the victim, the defendant got away from his cell phone, and the defendant was pushed down with the wall and boomed with the wall.
