Defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

[Criminal Power] On April 14, 2014, the Defendant was issued a summary order of KRW 2 million by the Seoul Western District Court for a violation of the Road Traffic Act (driving).

피고인은 2020. 7. 30. 불상 시각경 서울 서대문구 홍제동 이하 불상지에서부터 같은 구 경기대로 72 충현동 제1공영주차장 3층까지 술을 마신 상태로 B SM6 승용차를 운전하여 온 후 승용차 안에서 잠이 들어, 같은 날 15:48경 이를 목격한 신고자의 112신고를 받고 출동한 서울서대문경찰서 C지구대 소속 경장 D으로부터 피고인에게서 술 냄새가 심하게 나고 피고인의 눈이 빨갛게 충혈되고 혀가 꼬여 발음이 부정확한 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 같은 날 16:30경부터 16:45경까지 약 15분 동안 3회에 걸쳐 음주측정기에 입김을 불어 넣는 방법으로 음주측정에 응할 것을 요구받았다.

그럼에도 피고인은 음주측정기에 입김을 불어 넣는 시늉만 하거나 현장을 이탈하려는 방법으로 이를 회피하여 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 않았다.
