1. 감정의뢰회보 변호인과 피고인의 주장에 관한 판단 피해자는 이 사건 발생 직후 ‘피고인이 엉덩이 부위에 정액을 묻혔다. 엉덩이를 만졌다.’는 내용의 진술서를 작성하였고(수사기록 8쪽), 수사기관에서도 ‘누군가 엉덩이를 만지는 기분이 들어서 일어났다. 그 남자가 만진 엉덩이 부위 바지 위에 정액으로 생각되는 액체가 묻어 있었다. 엉덩이를 움켜잡는 느낌은 아니었고, 손바닥으로 슥 건드리는 느낌이었다. 엉덩이를 만지는 느낌에 놀라서 일어났다.’는 취지로 진술하였으며(수사기록 22-23쪽), 이 법정에서 증인으로 출석하여서도 ‘엉덩이를 만지니까 일어난 것이다.’는 취지로 증언하였는바 위와 같은 진술의 일관성, 피해자는 범죄사실 기재 피고인의 추행 행위의 태양에 대하여 일관되게 진술하고 있는바, 이 사건 범행 당시와 수사기관 및 법정에서의 각 진술 시기의 간격 등에 비추어 사소한 부분의 진술에 일부 차이가 있다고 하여 그와 같은 사정만으로 피해자의 진술을 믿을 수 없다고 할 수 없다.
